Fees

In most personal injury cases, attorney fees are paid on a "Contingent Fee" basis. Under this type of fee arrangement, the attorney is paid a percentage of what is recovered for the client, usually 33-1/3% to 40% of the monetary amount obtained in the case.

No-Fault Auto Accidents

Hawaii has a no-fault law for auto accident cases which requires an injured person to meet a certain threshold before being able to proceed with a lawsuit. Essentially the injured person must meet one of the following criteria in order to proceed:

  • Medical/rehabilitative expenses exceeding $5000; or
  • Injury which consists in whole or part in a "significant permanent loss of use of a part or function of the body"; or
  • Injury which consists of a "permanent and serious disfigurement which results in ... mental or emotional suffering."
